SUBROGATION
Subrogation matters are civil personal injury cases arising from industrial accidents such as auto and construction accidents, falls and product defects. Subrogation is very complicated, and success in this area requires in depth knowledge of the law and understanding of it's practical applications. With subrogation matters, the sooner the analysis and investigation begins, the better. By acting quickly, key evidence can be preserved and the memories of witnesses are fresh, the physical evidence of an auto accident or industrial mishap can be retained. Our attorneys will work closely with the workers' compensation attorneys and./or claims representatives to resolve claims efficiently and achieve the lowest net payment possible whether the matter is eventually settled or negotiated in trial.
LABOR CODE 132a &
SERIOUS AND WILLFUL MISCONDUCT
Labor Code Section 132a states that employers who discriminate or retaliate against employees because of the filing of workers' comp claims or expressing their intention to do so face the prospect of costly fines and the possibility of employee lawsuits. Even if an employee was discharged for a legitimate business or personnel reason, the legitimate reason can be difficult to prove. Our firm thoroughly investigates the accident and injury, the employer's human resources policies and procedures, and the exact events leading up to the discharge or other negative consequence.
Serious and Willful misconduct claims are both strict and harsh. The workers' compensation system is designed to provide compensation for employees who are injured on the job. However, the employer still has the responsibility to maintain a safe work environment. We will examine all aspects of the case, hiring investigators and expert witnesses, if necessary. Our goal in every case is to protect the rights and interests of our client, the employer, and to minimize any resulting fines or penalties - if not to achieve the employer's vindication. When the firm's clients are accused of violations of California Labor Code section 132a or serious and willful misconduct, the attorneys energetically defend the rights and interests of the clients.
